Should you invest in Collector Passing Property?



Collector Passing Property is the commonly used terminology for properties (houses, plots or flats) that receive the Collector’s permission for construction. In areas such as Vasai, Virar and Nalasopara, several such properties are available and are attracting buyers. However, such buyers are concerned over the legality of such properties.

Paresh from Navi Mumbai asks on Open House, the Discussion Forum on Magicbricks, “What is a Collector Passing Project? Will there be any legal problem if I purchase such property?” Nikhil, on the other hand, also wants to know about the documents and stamp duty charges. He asks, “I have booked a 525 sq ft flat in Virar East but this property is under load bearing in Collector passing approval. Will it have any problem in future? Is it a legal construction? Which documents should be checked before finalising the agreement? Also, what is stamp duty on it?

Answering both queries, George L Fargoes, advocate practicing in Vasai Civil and Criminal Court says, “When a person purchases a flat or a plot or a house, it must be on a Non-Agricultural land. If it’s not, the owner or builder has to apply to the Collector to get the agricultural land converted into residential. This is why they are known as Collector Passing Property.”

Fargoes continues further, “Once the owner or builder gets the Collector’s approval, he/she can then apply to the Municipal Corporation or City and Industrial Development Corporation of Maharashtra (CIDCO) to get permission for starting construction i.e. Commencement Certificate. After completion they need to apply for Completion Certificate and later Occupancy Certificate once they are sold out.”
